Terms of Sale and Use

Weapons & Wildflowers, LLC

These terms apply when you use weaponsandwildflowers.com or buy anything from us, including the Field Guide, the Independent Film Investor Toolkit, and 1:1 creative sessions. By using the site or making a purchase, you agree to these terms. If you do not agree, please do not use the site or buy our products.

1. What you get when you buy a digital product

When you buy the Field Guide or the Toolkit, you get a personal, non-transferable license to download and use it for your own projects and learning.

You may:

  • Download it and keep copies on your own devices
  • Print it for your own use
  • Use the ideas and templates in your own film projects

You may not:

  • Share, forward, or upload the files for others to download
  • Resell, rent, or give away the files, or include them in another product, course, or paid service
  • Remove our name, branding, or copyright notices

If you want to use our materials with a team, class, or organization, email us and we will work something out.

How delivery works: after you pay through Stripe, you are taken to a private download page where you can download your file right away, and Stripe emails you a receipt. Please save your file once you have downloaded it. If you have trouble downloading or lose access, email us. Your download page and links are for you only; sharing them is a breach of these terms and may end your license without a refund.

2. Filmmaking experience, not legal, tax or investment advice

Our guides, the Toolkit, and sessions share filmmaking and industry knowledge drawn from Philip Plowden’s more than 20 years of experience. They are for general informational and educational use. They are not legal, tax, accounting, securities, or investment advice.

  • It is not legal, tax, accounting, securities, or investment advice.
  • Philip Plowden is a working filmmaker and producer, not your lawyer, accountant, or financial advisor, and nothing said creates a lawyer-client, advisor-client, or fiduciary relationship.
  • Weapons & Wildflowers, LLC and Philip Plowden are not broker-dealers, investment advisers, or finders. We do not review, recommend, or endorse any specific investment, and we do not accept compensation for introducing investors.
  • Raising money for a film can involve securities laws and tax rules. Before you raise money, sign agreements, or make financial decisions, talk to a qualified attorney and accountant where you live.
  • Any templates and sample documents are illustrative examples to help you learn and prepare. They are not legal forms and are not tailored to your situation. Have a professional review anything before you use it.
  • Laws change; check current requirements with your own attorney.

3. No investment offers

Weapons & Wildflowers, LLC is not offering or asking anyone to invest in any film, company, or project through this site, our products, or our sessions. Nothing here is an offer to sell, or a request for an offer to buy, any security or investment. The Investor Toolkit teaches filmmakers how to prepare for conversations with potential investors; it is not an investment opportunity.

Nothing on this website, in our products, or in our sessions is an offer or solicitation relating to any offering by Weapons & Wildflowers, LLC, any affiliated company, or any film project, and no such offering is made through this site.

We are not a broker-dealer, investment adviser, or finder, and we do not accept compensation for introducing investors.

4. No guarantee of results

Every project is different. We share our experience and the approaches we have seen work, but we cannot promise any particular outcome, such as raising money, getting a film made, getting distribution, or earning a profit. Your results depend on you, your project, and many things outside our control. Individual results vary.

5. 1:1 creative sessions

  • Sessions are booked and paid through Calendly (currently 30 minutes, $125; 60 minutes, $225). The price shown on the Calendly booking page when you book applies. Cancellation and refund rules are in our Refund Policy.
  • Sessions are one-on-one conversations based on Philip Plowden’s filmmaking and industry experience. The limits in sections 2 and 3 apply: they are not legal, tax, or investment advice, and nothing is an offer to invest. We do not discuss or accept investment in any offering through a session.
  • Please do not send us confidential material you are not allowed to share. We do not sign NDAs for standard sessions unless we agree in writing in advance.
  • We will not record a session without asking you first.

6. Payments and pricing

  • Prices are in US dollars and shown on the site at the time you buy. We may change prices at any time, but changes will not affect purchases you have already made.
  • Payments are processed securely by Stripe. Refunds are covered by our Refund Policy.

7. Intellectual property

All content on this site and in our products, including text, guides, templates, images, film stills, logos, and the Weapons & Wildflowers name, belongs to Weapons & Wildflowers, LLC or is used with permission, and is protected by copyright and trademark law. Buying a product gives you the personal license in Section 1; it does not transfer ownership. Please do not copy or reuse our content beyond what these terms allow without written permission.

8. Using the website

Please use the site lawfully. Do not try to break, hack, overload, or copy the site, or access the download pages or files in ways not intended for you. Links to other websites (like Stripe, Calendly, or social media) are provided for convenience; we are not responsible for their content or practices.

9. Disclaimer

The site, products, and sessions are provided “as is.” To the fullest extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or accuracy. Information may become outdated, and laws change.

10. Limitation of liability

To the fullest extent the law allows, Weapons & Wildflowers, LLC and its members, managers, employees, and contractors will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, lost funding, or lost opportunities, arising from your use of the site, products, or sessions. Our total liability for any claim is limited to the amount you paid us for the product or session involved.

Nothing in these terms limits liability that cannot be limited by law, including for fraud or willful misconduct. Some states do not allow certain exclusions or limits on damages, so some of these limits may not apply to you.

11. Governing law

To the extent permitted by law, these terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-law rules. To the extent permitted by law, any dispute will be handled in the state or federal courts located in Cook County, Illinois, and you agree to that location.

12. General

  • Age: you must be 18 or older to buy from us or book a session.
  • Entire agreement: these terms, together with our Refund Policy and Privacy Policy, are the entire agreement between you and us about the site, our products, and our sessions.
  • Severability: if any part of these terms is found unenforceable, the rest of these terms stays in effect.
  • No waiver: if we do not enforce any part of these terms right away, we can still enforce it later.

13. Changes to these terms

We may update these terms from time to time. The version posted here, with its effective date, applies to purchases made while it is posted.
